PC §110 - AIDING A SUICIDE

CLASS E MISDEMEANOR

Section 1: Definitions

  1. Aiding a Suicide: The act of intentionally providing assistance, means, or encouragement to another person with the knowledge that such assistance will contribute to the person's death by suicide.

  2. Person: Any individual, partnership, corporation, association, or other entity.

  3. Means: Any method, instrument, or device used to commit suicide, including but not limited to drugs, weapons, or instructions.

Section 2: Offenses

  1. Providing Means for Suicide:

    • It shall be unlawful for any person to intentionally provide any means or instrument with the knowledge that it will be used by another person to commit suicide.

  2. Encouraging Suicide:

    • It shall be unlawful for any person to intentionally encourage, persuade, or induce another person to commit suicide.

  3. Assisting in Suicide:

    • It shall be unlawful for any person to physically assist another person in the act of committing suicide.

Section 3: Exceptions

  1. Medical Assistance in Dying:

    • This code shall not apply to acts of medical assistance in dying that are conducted in accordance with applicable laws and regulations, where the person has provided informed consent and meets the legal criteria for such assistance.

  2. Good Samaritan Acts:

    • This code shall not apply to individuals who, in good faith, attempt to prevent suicide by providing support, intervention, or contacting emergency services.

Penalties for aiding a suicide can vary widely depending on the jurisdiction and the specific circumstances of the offense. They may include:
