PC §806 - FAILURE TO HAVE PROPER ESCORT FOR A LOAD

INFRACTION

Section 1: Definitions

  • Escort Vehicle: A vehicle required by law to accompany a transport vehicle carrying an oversized or otherwise regulated load to ensure safety and compliance with legal requirements.

  • Oversized Load: A load that exceeds the standard dimensions or weight limits set by regulatory authorities and requires special provisions, including escorts, for safe transport.

  • Regulatory Authority: Any government agency or body responsible for overseeing and enforcing requirements related to load escorts and oversized load transport, including but not limited to the Department of Transportation (DOT) or similar entities.

  • Failure to Have Proper Escort: The act of not having the required escort vehicle(s) for transporting an oversized load, or failing to adhere to escort-related regulations and requirements.

Section 2: Offenses

  • Failure to Provide Required Escort Vehicle:

    • It shall be unlawful for any person to transport an oversized load without providing the required escort vehicle(s) as mandated by regulatory authorities.

  • Non-Compliance with Escort Regulations:

    • It shall be unlawful for any person to fail to comply with specific regulations related to escort vehicles, including but not limited to the number of escort vehicles, their positioning, or their operational duties during transport.

  • Inadequate Escort Vehicle Equipment:

    • It shall be unlawful for any person to use an escort vehicle that does not meet the required equipment and operational standards established by regulatory authorities.

  • Failure to Maintain Escort Vehicle Communication:

    • It shall be unlawful for any person to fail to maintain effective communication between the escort vehicle(s) and the transport vehicle carrying the oversized load.

Section 3: Additional Provisions

  1. Revocation of Operating Licenses:

    • The court may order the revocation or suspension of the commercial operating license of any person or entity convicted of falsification of travel logs or repeated violations of travel log regulations.

  2. Tow:

    • The law enforcement officer may tow the tractor and trailer due to the lack of a valid CDL of San Andreas.

Section 4: Exceptions

  1. Lawful Record-Keeping:

    • This code shall not apply to instances where travel logs are maintained in accordance with lawful record-keeping practices and regulatory requirements, and where any deficiencies are promptly corrected.

  2. Unintentional Errors:

    • This code shall not apply to instances where errors in travel logs are proven to be unintentional and promptly corrected upon discovery, provided that no intentional falsification or obstruction of regulatory requirements is involved.
