PC §305(A) - DESTRUCTION OF GOVERNMENT PROPERTY

CLASS D MISDEMEANOR

Section 1: Definitions

  1. Destruction of Government Property: Any act of willfully damaging, defacing, or destroying property owned, leased, or controlled by a government entity without proper authorization.

  2. Government Property: Any tangible or intangible item owned, leased, or controlled by federal, state, local, or municipal government entities, including but not limited to buildings, vehicles, equipment, and infrastructure.

  3. Willfully: Acting intentionally and with a purpose to commit the act in question.

  4. Government Entity: Any federal, state, local, or municipal agency, department, or organization.

Section 2: Offenses

  1. Willful Destruction of Government Property:

    • It shall be unlawful for any person to willfully damage, deface, or destroy government property without proper authorization.

  2. Vandalism of Government Property:

    • It shall be unlawful for any person to willfully deface government property with graffiti or other inscribed materials without proper authorization.

  3. Arson of Government Property:

    • It shall be unlawful for any person to willfully and maliciously set fire to or burn any government property.

  4. Tampering with Government Equipment:

    • It shall be unlawful for any person to willfully tamper with, disable, or otherwise interfere with the operation of government equipment or infrastructure.

Section 3: Exceptions

  1. Emergency Situations:

    • This code shall not apply to actions taken in good faith during emergency situations where immediate action is required to prevent harm, and the damage is a necessary consequence of addressing the emergency.

  2. Lawful Authority:

    • This code shall not apply to law enforcement, emergency, or government personnel performing their official duties within the scope of their employment and in accordance with applicable laws and policies.
