CLASS E MISDEMEANOR

Section 1: Definitions

  1. Public Endangerment: Any action or behavior that recklessly creates a substantial risk of serious bodily harm, death, or significant property damage to the public or a group of people.

  2. Person: Any individual, partnership, corporation, association, or other entity.

  3. Serious Bodily Harm: Any injury that involves a substantial risk of death, extreme physical pain, protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty.

  4. Recklessly: Acting with disregard for the known risks and consequences of one's actions, showing a blatant indifference to the safety and well-being of others.

Section 2: Offenses

  1. Reckless Endangerment:

    • It shall be unlawful for any person to recklessly engage in conduct that creates a substantial risk of serious bodily harm or death to another person or the public.

  2. Endangerment through Hazardous Activities:

    • It shall be unlawful for any person to engage in hazardous activities, including but not limited to handling dangerous substances, operating machinery, or performing stunts, in a manner that endangers public safety.

  3. Endangerment through Negligent Acts:

    • It shall be unlawful for any person to negligently fail to maintain property, equipment, or conditions under their control, resulting in a substantial risk of serious bodily harm, death, or significant property damage to the public.

Section 3: Exceptions

  1. Emergency Situations:

    • This code shall not apply to actions taken in good faith during emergency situations where immediate action is required to prevent harm, and the risks are outweighed by the need to address the emergency.

  2. Lawful Activities:

    • This code shall not apply to activities conducted in compliance with laws, regulations, and safety standards, provided that reasonable precautions are taken to protect public safety.

  3. Official Duties:

    • This code shall not apply to law enforcement, emergency, or government personnel performing their official duties, provided they act within the scope of their employment and in accordance with applicable laws and policies.
