PC §900 - HUNTING LICENSE AND TAGS

CLASS C MISDEMEANOR

(a) Definition

A hunting license and tags are required for legal hunting activities in San Andreas. A hunting license allows individuals to hunt and fish within the state, while tags are specific to certain game species and are required for their harvest.

Types of Licenses and Tags

  • Hunting License: Allows for general hunting activities.

  • Tags: Required for specific big game species, such as deer, elk, or bear.

(b) Elements of the Offense

The following elements must be met to constitute an offense related to hunting licenses and tags:

  1. The defendant engaged in hunting activities without a valid San Andreas hunting license.

  2. The defendant hunted a species requiring a tag without possessing a valid tag for that species.

  3. The hunting occurred during a season or in a zone where a license and/or tag are required.

(c) Defenses

(a) It shall be a defense if the defendant can prove that they had obtained a valid license or tag but was not in possession at the time due to an oversight. (b) Evidence of having applied for or being in the process of obtaining a license or tag may also serve as a defense if proven by the defendant.

(d) Aggravating Factors

Aggravating factors such as repeated offenses, hunting without any license or tags, or hunting protected species may result in increased penalties or additional charges as determined by the court.
