PC §727 - EXCESSIVE USE OF A HORN

INFRACTION

(a) Definition

Excessive use of a horn is the act of repeatedly and unnecessarily sounding the horn of a motor vehicle in a manner that creates a disturbance or annoyance to others.

(b) Elements of the Offense

The following elements must be met to constitute a charge of excessive use of a horn:

  1. The defendant operated a motor vehicle equipped with a horn.

  2. The defendant repeatedly and unnecessarily sounded the horn of the vehicle.

  3. The defendant's actions created a disturbance or annoyance to others, such as other motorists, pedestrians, or residents in the vicinity.

Prohibited Conduct

Prohibited conduct may include, but is not limited to, the following actions by vehicle operators:

  1. Excessively honking the horn in response to minor traffic delays or inconveniences.

  2. Using the horn as a means of expressing frustration, impatience, or anger towards other road users.

  3. Continuously sounding the horn in residential areas during quiet hours or late at night.

(c) Defenses

  • (a) It shall be a defense to a charge of excessive use of a horn if the defendant can prove that their actions were justified under the circumstances, such as when warning other motorists of an imminent collision or danger.

  • (b) Lack of evidence of excessive use of a horn, such as errors in law enforcement observations or documentation, may also serve as defenses if proven by the defendant.

(d) Aggravating Factors

  • Aggravating factors such as causing accidents, injuries, or disturbances to public peace due to excessive use of a horn, repeated violations, or prior convictions for similar offenses may result in enhanced penalties or additional charges as determined by the court.
