PC §712 - IMPEDING TRAFFIC
INFRACTION
(a) Definition
Impeding traffic is the act of obstructing or hindering the normal flow of vehicular or pedestrian movement on a public roadway, street, or highway.
(b) Elements of the Offense
The following elements must be met to constitute impeding traffic:
The defendant obstructed or hindered the normal flow of vehicular or pedestrian movement on a public roadway, street, or highway.
The obstruction or hindrance resulted in congestion, delays, or unsafe conditions for other road users.
The defendant's actions were intentional or negligent, and they knew or should have known that their conduct would impede traffic.
Types of Impeding Traffic
(a) Impeding traffic may include, but is not limited to, the following actions:
Parking or stopping a vehicle in a manner that obstructs the flow of traffic.
Blocking or restricting lanes of travel without proper authorization or safety precautions.
Engaging in activities such as construction, maintenance, or events that impede traffic without proper permits or traffic control measures.
Encouraging or participating in protests, demonstrations, or gatherings that obstruct roadways or intersections.
(c) Defenses
(a) It shall be a defense to a charge of impeding traffic if the defendant can prove that their actions were justified under the circumstances, such as emergency situations or authorized road closures.
(b) Lack of evidence of impeding traffic, such as errors in law enforcement observations or documentation, may also serve as defenses if proven by the defendant.
(d) Aggravating Factors
Aggravating factors such as causing accidents or injuries due to impeding traffic, obstructing emergency vehicles, or prior convictions for similar offenses may result in enhanced penalties or additional charges as determined by the court.
