PC §709 - FAILURE TO USE A TURN SIGNAL

INFRACTION

(a) Definition

Failure to use a turn signal is the act of operating a motor vehicle without properly signaling an intended turn or lane change, as required by traffic laws and regulations.

(b) Elements of the Offense

The following elements must be met to constitute failure to use a turn signal:

  1. The defendant operated a motor vehicle on a public roadway.

  2. The defendant failed to use a turn signal to indicate an intended turn or lane change.

  3. The failure to use a turn signal resulted in a violation of traffic laws or regulations.

Types of Violations

(a) Violations of failure to use a turn signal may include, but are not limited to, the following:

  1. Failing to use a turn signal when making a left or right turn at an intersection or onto a different road.

  2. Failing to use a turn signal when changing lanes on a multi-lane roadway or highway.

  3. Failing to use a turn signal when merging onto or exiting from a freeway or highway.

  4. Failing to use a turn signal when pulling over to the side of the road or making a U-turn.

(c) Defenses

  • (a) It shall be a defense to a charge of failure to use a turn signal if the defendant can prove that they were unable to use their turn signal due to mechanical failure or other extenuating circumstances beyond their control.

  • (b) Lack of evidence of failure to use a turn signal, such as witness testimony or physical evidence, may also serve as defenses if proven by the defendant.

(d) Aggravating Factors

  • Aggravating factors such as causing an accident resulting in property damage or injury to others, repeatedly violating turn signal laws, or prior convictions for similar offenses may result in enhanced penalties or additional charges as determined by the court.
