PC §305 - DESTRUCTION OF PROPERTY

CLASS E MISDEMEANOR

Section 1: Definitions

  1. Destruction of Property: Any act of willfully damaging, defacing, or destroying another person’s property without consent.

  2. Property: Any tangible or intangible item owned by an individual, partnership, corporation, association, or other entity, including but not limited to buildings, vehicles, personal belongings, and public utilities.

  3. Willfully: Acting intentionally and with a purpose to commit the act in question.

Section 2: Offenses

  1. Willful Destruction of Property:

    • It shall be unlawful for any person to willfully damage, deface, or destroy another person’s property without the owner’s consent.

  2. Vandalism:

    • It shall be unlawful for any person to willfully deface property with graffiti or other inscribed materials without the owner’s consent.

  3. Destruction of Public Property:

    • It shall be unlawful for any person to willfully damage, deface, or destroy property owned by the public or the government.

  4. Arson:

    • It shall be unlawful for any person to willfully and maliciously set fire to or burn any structure, forest land, or property.

Section 5: Exceptions

  1. Emergency Situations:

    • This code shall not apply to actions taken in good faith during emergency situations where immediate action is required to prevent harm, and the damage is a necessary consequence of addressing the emergency.

  2. Lawful Authority:

    • This code shall not apply to law enforcement, emergency, or government personnel performing their official duties within the scope of their employment and in accordance with applicable laws and policies.
