PC §403 - HUMAN TRAFFICKING
CLASS B FELONY
(a) Definition
Human trafficking is the recruitment, transportation, transfer, harboring, or receipt of persons, by means of force, fraud, coercion, deception, abduction, or abuse of power, for the purpose of exploitation. Exploitation may include forced labor or services, slavery, servitude, or the removal of organs.
(b) Elements of the Offense
The following elements must be met to constitute human trafficking:
The recruitment, transportation, transfer, harboring, or receipt of persons.
The use of force, fraud, coercion, deception, abduction, or abuse of power.
The purpose of exploitation, such as forced labor or services, slavery, servitude, or organ removal.
Types of Human Trafficking
Human trafficking may include, but is not limited to, the following:
Labor trafficking: The recruitment, transportation, transfer, harboring, or receipt of persons for the purpose of forced labor or services.
Organ trafficking: The recruitment, transportation, transfer, harboring, or receipt of persons for the purpose of organ removal.
(c) Defenses
(a) It shall be a defense to a charge of human trafficking if the defendant can prove that the alleged actions did not meet the elements of the offense, or that the recruitment, transportation, transfer, harboring, or receipt of persons was lawful and not for the purpose of exploitation.
(b) Lack of knowledge or intent to engage in human trafficking, or coercion by others to participate in such activities, may also serve as defenses if proven by the defendant.
(e) Aggravating Factors
Aggravating factors such as the involvement of minors, use of violence, causing severe harm or death to victims, or involvement in organized crime may result in increased penalties as determined by the court.
