PC §111 - CRIMINAL THREATS

CLASS D MISDEMEANOR

Section 1: Definitions

  1. Criminal Threat: Any statement, communication, or action intended to instill fear of imminent serious bodily harm, death, or significant property damage in another person.

  2. Person: Any individual, partnership, corporation, association, or other entity.

  3. Serious Bodily Harm: Any injury that involves a substantial risk of death, extreme physical pain, protracted and obvious disfigurement, or protracted loss or impairment of the function of a bodily member, organ, or mental faculty.

  4. Communication: Any form of conveying a message, including but not limited to spoken or written words, electronic messages, gestures, or symbols.

Section 2: Offenses

  1. Making a Criminal Threat:

    • It shall be unlawful for any person to willfully threaten to commit a crime which will result in death, serious bodily harm, or significant property damage to another person, with the specific intent that the statement be taken as a threat, regardless of whether the person intends to actually carry out the threat.

  2. Communicating a Criminal Threat:

    • It shall be unlawful for any person to knowingly communicate a threat to another person by any means, with the intent to place that person in fear of imminent serious bodily harm, death, or significant property damage.

  3. Threatening Public Safety:

    • It shall be unlawful for any person to make a threat that disrupts public safety or causes the evacuation of any building, place of assembly, or facility of public transportation.

Section 3: Additional Provisions

  1. Protective Orders:

    • The court may issue protective orders prohibiting any person convicted of an offense under this code from contacting or approaching the victim or any other persons designated by the court.

Section 4: Exceptions

  1. Constitutionally Protected Speech:

    • This code shall not apply to speech or expressions that are protected by the Constitution, including the First Amendment rights to free speech and peaceful assembly, unless such speech constitutes a true threat as defined by law.

  2. Good Faith Reports:

    • This code shall not apply to individuals who, in good faith, report potential threats to law enforcement or other authorities.
