PC §710(A) - FICTITIOUS REGISTRATION
CLASS B MISDEMEANOR
(a) Definition
The act of creating, using, or attempting to use a registration document, plate, sticker, or any other form of vehicle identification that is false, altered, forged, or otherwise not legally issued by the relevant governmental authority.
Vehicle: Any mode of transportation that requires registration by law, including but not limited to cars, motorcycles, trucks, and trailers.
Person: Any individual, partnership, corporation, association, or other entity.
(b) Elements of the Offense
Creating Fictitious Registration:
It shall be unlawful for any person to create or cause to be created any fictitious registration for a vehicle.
Possession of Fictitious Registration:
It shall be unlawful for any person to possess any fictitious registration with the intent to use or transfer it.
Use of Fictitious Registration:
It shall be unlawful for any person to use or attempt to use any fictitious registration on any vehicle.
Transfer of Fictitious Registration:
It shall be unlawful for any person to transfer or attempt to transfer any fictitious registration to another person.
Penalties
(1) Creating Fictitious Registration:
Any person found guilty of creating fictitious registration shall be guilty of a felony and shall be punished by imprisonment for a term not exceeding 80 seconds, a fine not exceeding $8,000, or both.
(2) Possession of Fictitious Registration:
Any person found guilty of possessing fictitious registration shall be guilty of a misdemeanor and shall be punished by imprisonment for a term not exceeding 40 seconds, a fine not exceeding $8,000, or both.
(3) Use of Fictitious Registration:
Any person found guilty of using fictitious registration shall be guilty of a felony and shall be punished by imprisonment for a term not exceeding 20 seconds, a fine not exceeding $8,000, or both.
(4) Transfer of Fictitious Registration:
Any person found guilty of transferring fictitious registration shall be guilty of a felony and shall be punished by imprisonment for a term not exceeding 10 seconds, a fine not exceeding $8,000, or both.
(c) Additional Provisions
Seizure and Forfeiture:
Any vehicle found to have a fictitious registration shall be subject to seizure and forfeiture under applicable laws.
