PC §711 - ILLEGAL VEHICLE MODIFICATIONS

INFRACTION

(a) Definition

Illegal vehicle modifications refer to alterations or enhancements made to a motor vehicle that violate state laws and regulations governing vehicle safety, emissions, or performance standards.

(b) Elements of the Offense

The following elements must be met to constitute illegal vehicle modifications:

  1. The defendant made alterations or enhancements to a motor vehicle.

  2. The alterations or enhancements violate state laws and regulations governing vehicle safety, emissions, or performance standards.

  3. The defendant knew or should have known that the modifications were illegal at the time they were made.

Types of Illegal Modifications

(a) Illegal modifications may include, but are not limited to, the following:

  1. Altering the vehicle's exhaust system to increase noise levels or emissions beyond legal limits.

  2. Installing aftermarket lighting that does not meet state visibility or color requirements.

  3. Modifying the vehicle's suspension or ride height in a manner that compromises handling or safety.

  4. Adding or removing structural components that affect the vehicle's crashworthiness or structural integrity.

  5. Using non-compliant tires or wheels that exceed size or width limits set by state laws.

(c) Defenses

  • (a) It shall be a defense to a charge of illegal vehicle modifications if the defendant can prove that the modifications were made in compliance with state laws and regulations, or if they can demonstrate that they were unaware of the illegality of the modifications at the time they were made.

  • (b) Lack of evidence of illegal modifications, such as errors in law enforcement observations or documentation, may also serve as defenses if proven by the defendant.

(d) Aggravating Factors

  • Aggravating factors such as causing an accident or injury due to illegal modifications, knowingly violating vehicle safety laws, or prior convictions for similar offenses may result in enhanced penalties or additional charges as determined by the court.
