PC §704 - FAILURE TO MAINTAIN LANES
INFRACTION
(a) Definition
Failure to maintain lanes is the act of operating a motor vehicle in violation of traffic laws requiring drivers to stay within designated lanes of travel on roadways.
(b) Elements of the Offense
The following elements must be met to constitute failure to maintain lanes:
The defendant operated a motor vehicle on a public roadway.
The defendant failed to keep their vehicle within the designated lane(s) of travel.
The failure to maintain lanes resulted in a violation of traffic laws or regulations.
Types of Violations
(a) Violations of failure to maintain lanes may include, but are not limited to, the following:
Drifting across lane lines without signaling or changing lanes improperly.
Weaving in and out of lanes without due regard for other vehicles.
Failing to stay within marked lanes during turns or lane changes.
Crossing over solid lane markings without a lawful reason.
(c) Defenses
(a) It shall be a defense to a charge of failure to maintain lanes if the defendant can prove that they were forced out of their lane by another vehicle or external factors beyond their control, or if they can demonstrate that they were coerced, misled, or otherwise not acting of their own free will.
(b) Lack of evidence of failure to maintain lanes behavior, such as witness testimony or physical evidence, may also serve as defenses if proven by the defendant.
(d) Aggravating Factors
Aggravating factors such as causing an accident resulting in property damage or injury to others, driving under the influence of alcohol or drugs, or prior convictions for similar offenses may result in enhanced penalties or additional charges as determined by the court.
