PC §301(A) - AGGRAVATED TRESPASSING

CLASS B MISDEMEANOR

(a) Definition

Aggravated trespassing is the intentional and unauthorized entry onto the property of another individual or entity with the intent to commit a felony, theft, or vandalism, or causing significant damage to property.

(b) Elements of the Offense

The following elements must be met to constitute aggravated trespassing:

  1. Intentional and unauthorized entry onto the property of another.

  2. Presence on the property with the intent to commit a felony, theft, vandalism, or causing significant damage to property.

(c) Defenses

Defenses to a charge of vehicular manslaughter may include, but are not limited to:

  • (a) It shall be a defense to a charge of aggravated trespassing if the defendant can prove that they did not have the intent to commit a felony, theft, vandalism, or cause significant damage to property while entering or remaining upon the property.

  • (b) Self-defense or defense of another person may also serve as a defense to a charge of aggravated trespassing if the defendant's actions were necessary to protect themselves or others from imminent harm.

Enhanced Penalties

  • (a) If the aggravated trespassing results in severe harm to persons or property, the court may impose enhanced penalties, including increased fines or extended imprisonment.
