PC §1004 - FAILURE TO DISPLAY REGISTRATION NUMBER

INFRACTION

(a) Definition

Failure to display registration numbers involves not properly displaying the required registration numbers and decals on a vessel as mandated by San Andreas law.

Types of Display Requirements

  • Registration Numbers: Must be clearly visible on the hull of the vessel.

  • Decals: Registration decals must be displayed as prescribed, typically near the registration numbers.

(b) Elements of the Offense

The following elements must be met to constitute a failure to display registration numbers:

  1. The defendant’s vessel was required to be registered.

  2. The vessel did not have the registration numbers or decals displayed as required.

  3. The infraction occurred on San Andreas waters.

(c) Defenses

(a) It shall be a defense if the defendant can prove that the vessel was newly registered, and they were in the process of obtaining or affixing the registration numbers and decals. (b) Evidence that the registration numbers were temporarily obscured due to unforeseen circumstances may also serve as a defense.

(d) Aggravating Factors

Aggravating factors such as repeat offenses or operating a vessel in high-visibility areas without proper display may result in increased penalties or additional actions as determined by the court.
