INFRACTION

(a) Definition

Boating license and registration laws require operators to have a valid license and vessels to be registered to ensure compliance with state regulations and promote safe boating practices.

Types of Licenses and Registrations

  • Boating License: Certification required for operating certain types of vessels, such as personal watercraft.

  • Boat Registration: Required for all motorized boats and sailboats, indicating legal ownership and compliance with state regulations.

(b) Elements of the Offense

The following elements must be met to constitute an offense related to boating licenses and registration:

  1. The defendant operated a vessel without a valid boating license when one is required.

  2. The defendant operated an unregistered vessel or failed to display valid registration numbers and decals.

  3. The offense occurred within San Andreas waters where such regulations apply.

(c) Defenses

(a) It shall be a defense if the defendant can prove they were in the process of obtaining a license or registration and had submitted all necessary paperwork. (b) Evidence that the defendant's vessel was temporarily exempt from registration requirements due to specific circumstances (e.g., loaned to a friend) may also serve as a defense.
