CLASS C MISDEMEANOR

(a) Definition

Hunting seasons and bag limits are regulations that dictate when and how many animals a hunter can legally harvest. These regulations are established to ensure sustainable wildlife management.

Types of Seasons and Limits

  • Seasons: Specific times during which hunting of certain species is allowed.

  • Bag Limits: The maximum number of animals that can be harvested per day or season.

(b) Elements of the Offense

The following elements must be met to constitute an offense related to hunting seasons and bag limits:

  1. The defendant hunted a species outside of the established season.

  2. The defendant exceeded the bag limit for a particular species.

  3. The offense occurred within a region where specific season and limit regulations apply.

(c) Defenses

(a) It shall be a defense if the defendant can prove they were hunting within the allowed season or bag limit as per the regulations, or if there was a legitimate mistake or confusion regarding the regulations. (b) Evidence that the defendant acted under a valid permit or correctional notice may also serve as a defense.

(d) Aggravating Factors

Aggravating factors such as repeated violations, hunting protected or endangered species, or committing violations while hunting big game may result in increased penalties or additional charges as determined by the court.
