PC §413 - FAILURE TO PAY A FINE

CLASS E MISDEMEANOR

Section 1: Definitions

  1. Fine: A monetary penalty imposed by a court or other legal authority as part of a sentence or judgment for a criminal or civil offense.

  2. Failure to Pay a Fine: The act of not making required payments towards a fine imposed by a court or legal authority within the specified time frame, without valid justification or acceptable excuse.

  3. Court-Ordered Fine: A fine mandated by a court as part of a sentence or judgment following a legal proceeding.

  4. Legal Authority: Any official body or entity with the power to impose and enforce fines, including courts, regulatory agencies, or governmental bodies.

Section 2: Offenses

  1. Failure to Pay a Court-Ordered Fine:

    • It shall be unlawful for any person to willfully fail to pay a fine imposed by a court, if they have the financial ability to do so, and without having made arrangements for payment or having been granted an extension or alternative payment plan.

  2. Failure to Comply with Payment Plans:

    • It shall be unlawful for any person to fail to comply with the terms of a court-approved payment plan for a fine, including missing scheduled payments or failing to adhere to agreed-upon payment arrangements.

  3. Failure to Report Financial Status:

    • It shall be unlawful for any person to fail to provide accurate and timely information regarding their financial status when required by the court or legal authority for the purpose of determining their ability to pay a fine or to adjust payment plans.

Section 3: Exceptions

  1. Inability to Pay:

    • This code shall not apply to individuals who are genuinely unable to pay a fine due to financial hardship, provided they have made reasonable efforts to arrange payment or have applied for and been granted a hardship exemption.

  2. Medical or Exceptional Circumstances:

    • This code shall not apply to individuals who fail to pay a fine due to medical conditions or other exceptional circumstances beyond their control, provided they have provided appropriate documentation and requested a review or extension.
