PC §415 - FALSE INFORMATION TO A GOVERNMENT OFFICIAL

CLASS E MISDEMEANOR

Section 1: Definitions

  1. False Information: Any statement, report, or representation that is knowingly untrue or misleading and is intended to deceive or mislead a government official or agency.

  2. Government Official: Any person holding an official position in a government agency, department, or other governmental body, including elected officials, employees, and agents.

  3. Government Agency: Any department, office, or bureau of a local, state, or federal government that performs governmental functions and has the authority to receive or act upon information provided by the public.

  4. Knowingly: Being aware that the information provided is false or misleading.

Section 2: Offenses

  1. Providing False Information:

    • It shall be unlawful for any person to knowingly provide false information to a government official with the intent to deceive or mislead the official in the performance of their official duties.

  2. Fabrication of Evidence:

    • It shall be unlawful for any person to fabricate or falsify evidence with the intent to provide it to a government official, to mislead or obstruct the official’s duties.

  3. False Reporting:

    • It shall be unlawful for any person to make false reports or claims to a government agency, including false allegations or fabricated details, with the intent to deceive or mislead the agency.

  4. Obstruction of Government Functions:

    • It shall be unlawful for any person to knowingly provide false information to interfere with, obstruct, or hinder the lawful functions or investigations of a government agency or official.

Section 3: Exceptions

  1. Lawful Communication:

    • This code shall not apply to lawful communications or statements made in good faith, provided they do not involve knowingly false or misleading information.

  2. Whistleblower Protections:

    • This code shall not apply to individuals who report misconduct or illegal activities to government officials in accordance with whistleblower protection laws, provided the report is made in good faith and is not knowingly false.

  3. First Amendment Protections:

    • This code shall not apply to statements or information protected by the First Amendment, provided that such statements do not involve knowingly false or misleading information intended to deceive or obstruct.
