PC §407(B) - IMPERSONATION OF A EMT/FIREFIGHTER

CLASS F FELONY

(a) Definition

Impersonation of an EMT/firefighter is the act of knowingly and falsely representing oneself as an emergency medical technician (EMT) or firefighter, with the intent to deceive or defraud others.

(b) Elements of the Offense

The following elements must be met to constitute impersonation of an EMT/firefighter:

  1. The defendant knowingly and falsely represented themselves as an EMT or firefighter.

  2. The defendant acted with the intent to deceive or defraud others.

  3. The impersonation was done without authorization or lawful authority.

Types of Impersonation

Impersonation of an EMT/firefighter may include, but is not limited to, the following:

  1. Wearing a uniform or insignia indicating affiliation with an emergency medical service or fire department without proper authorization.

  2. Using language or behavior that implies training or certification as an EMT or firefighter.

  3. Falsely claiming to be responding to an emergency situation as an EMT or firefighter.

Penalties

Impersonation of an EMT/firefighter is a misdemeanor or felony offense, depending on the severity and impact of the impersonation.

  1. For misdemeanor cases, the offense is punishable by imprisonment in county jail for a period determined by the court, and/or fines not exceeding a certain amount, as specified by law.

  2. For felony cases, the offense is punishable by imprisonment in state prison for a period determined by the court, and/or fines not exceeding a certain amount, as specified by law.

(c) Defenses

  • (a) It shall be a defense to a charge of impersonation of an EMT/firefighter if the defendant can prove that the impersonation was authorized or lawful, or if they did not intend to deceive or defraud others.

  • (b) Lack of knowledge of the falsity of the representation or absence of intent to deceive or defraud may also serve as defenses if proven by the defendant.

(e) Aggravating Factors

Aggravating factors such as prior convictions for similar offenses, use of impersonation for financial gain or to cause harm, or impersonation during the commission of another crime may result in increased penalties as determined by the court.
