PC §1006 - FAILURE TO CARRY SAFETY EQUIPMENT

INFRACTION

(a) Definition

Failure to carry required safety equipment involves not having essential safety items on board a vessel as mandated by San Andreas law.

Types of Safety Equipment

  • Fire Extinguishers: Required for motorized vessels.

  • Distress Signals: Flares or signaling devices for emergency situations.

  • First Aid Kits: Recommended or required for certain vessels.

(b) Elements of the Offense

The following elements must be met to constitute a failure to carry required safety equipment:

  1. The defendant’s vessel was required to carry specific safety equipment.

  2. The required safety equipment was not on board or not accessible.

  3. The infraction occurred on San Andreas waters.

(c) Defenses

(a) It shall be a defense if the defendant can prove they were in the process of obtaining or replacing the required safety equipment when approached by authorities. (b) Evidence that the equipment was temporarily unavailable due to unforeseen circumstances may also serve as a defense.

(d) Aggravating Factors

Aggravating factors such as operating a vessel in high-risk conditions without the required equipment or repeat violations may result in increased penalties or additional actions as determined by the court.
