PC §500 - INDECENT EXPOSURE
CLASS B MISDEMEANOR
(a) Definition
Indecent exposure is the act of intentionally exposing one's genitals, buttocks, or female breasts in a public place or in the presence of others, with the intent to offend, shock, or alarm others.
Types of Exposure
(a) Indecent exposure may include, but is not limited to, the following:
Public nudity: Being fully or partially unclothed in public with the intent to shock or offend others.
Flashing: Quickly exposing one's genitals or female breasts to others without their consent.
Exhibitionism: Deliberately exposing one's genitals or engaging in sexual acts in public places to elicit a reaction from others.
(b) Elements of the Offense
The following elements must be met to constitute indecent exposure:
The defendant intentionally exposed their genitals, buttocks, or female breasts.
The exposure occurred in a public place or in the presence of others who might be offended, shocked, or alarmed by the exposure.
The defendant acted with the intent to offend, shock, or alarm others by the exposure.
(c) Defenses
(a) It shall be a defense to a charge of indecent exposure if the defendant can prove that their conduct was not intentional, accidental, or the result of coercion, or if they can demonstrate that the exposure occurred in a private setting where there was no reasonable expectation of being observed by others.
(b) Lack of intent to offend, shock, or alarm others by the exposure may also serve as a defense if proven by the defendant.
(d) Aggravating Factors
Aggravating factors such as prior convictions for similar offenses, the presence of minors or vulnerable individuals at the scene, or the use of force or coercion in committing the offense may result in increased penalties as determined by the court.
