PC §904 - HUNTING REGULATIONS AND SAFETY
CLASS B MISDEMEANOR
(a) Definition
Hunting regulations and safety laws ensure that hunters follow proper practices to protect public safety, wildlife, and the environment.
Types of Regulations and Safety Practices
Safety Courses: Completion of hunter safety courses and certification.
Reporting Harvest: Requirements for reporting harvested game.
Prohibited Activities: Restrictions on activities such as hunting with artificial light or from vehicles.
(b) Elements of the Offense
The following elements must be met to constitute an offense related to hunting regulations and safety:
The defendant failed to comply with safety regulations or reporting requirements.
The defendant engaged in prohibited hunting activities.
The failure to comply or prohibited activities occurred during hunting operations.
Failure to have Hunter Orange displayed such as: Top, Pants, Hats, Vests ETC...
(c) Defenses
(a) It shall be a defense if the defendant can prove compliance with all applicable regulations and that any violation was accidental or due to an honest mistake. (b) Evidence of taking corrective action or cooperating with authorities may also serve as a defense.
(d) Aggravating Factors
Aggravating factors such as repeated violations, endangering others with unsafe practices, or committing violations while hunting high-risk game may result in increased penalties or additional charges as determined by the court.
