PC §801(A) - OPERATING A COMMERCIAL VEHICLE ON A INVALID CDL LICENSE

CLASS E MISDEMEANOR

Section 1: Definitions

  • Commercial Driver’s License (CDL): A driver’s license required to operate a commercial vehicle, which includes trucks, buses, and other vehicles used for business purposes or for compensation.

  • Invalid CDL: A CDL that has been suspended, revoked, canceled, expired, or otherwise rendered invalid by regulatory authorities, or one that does not meet the necessary legal requirements for operating a commercial vehicle.

  • Commercial Vehicle: A motor vehicle used for transporting goods, passengers, or both, operated for business purposes or for compensation.

  • Regulatory Authority: Any government agency or body responsible for overseeing the issuance, maintenance, and regulation of commercial driver’s licenses, including but not limited to the Department of Transportation (DOT) or similar entities.

Section 2: Offense

  • It shall be unlawful for any person to operate a commercial vehicle with a CDL that is invalid due to suspension, revocation, cancellation, expiration, or other reasons that render the license invalid.

Section 3: Additional Provisions

  1. Revocation of Operating Licenses:

    • The court may order the revocation or suspension of the commercial operating license of any person or entity convicted of falsification of travel logs or repeated violations of travel log regulations.

  2. Tow:

    • The law enforcement officer may tow the tractor and trailer due to the lack of a valid CDL of San Andreas.

Section 4: Exceptions

  1. Lawful Record-Keeping:

    • This code shall not apply to instances where travel logs are maintained in accordance with lawful record-keeping practices and regulatory requirements, and where any deficiencies are promptly corrected.

  2. Unintentional Errors:

    • This code shall not apply to instances where errors in travel logs are proven to be unintentional and promptly corrected upon discovery, provided that no intentional falsification or obstruction of regulatory requirements is involved.
