PC §800(B) - FAILURE TO PROVIDE TRAVEL LOGS UPON REQUEST

INFRACTION

Section 1: Definitions

  1. Travel Logs: Official records maintained by the operator of a commercial vehicle that document the vehicle's travel activities, including but not limited to hours of operation, mileage, routes taken, and locations visited.

  2. Request: A formal or informal demand for travel logs made by a regulatory authority, law enforcement officer, or other authorized personnel, made in accordance with applicable regulations and laws.

  3. Commercial Vehicle: A motor vehicle used for the transportation of goods or passengers, operated for business purposes or for compensation.

  4. Regulatory Authority: Any government agency or body responsible for overseeing the operation and regulation of commercial vehicles, including but not limited to the Department of Transportation (DOT), Federal Motor Carrier Safety Administration (FMCSA), or similar entities.

Section 2: Offenses

  1. Failure to Provide Travel Logs Upon Request:

    • It shall be unlawful for any person or entity operating a commercial vehicle to fail to provide travel logs upon request by a regulatory authority or law enforcement officer, if the request is made in accordance with legal requirements.

  2. Refusal to Provide Travel Logs:

    • It shall be unlawful for any person or entity operating a commercial vehicle to refuse to provide travel logs when required by law or regulation, or when the request is made by a regulatory authority or law enforcement officer.

  3. Delayed Provision of Travel Logs:

    • It shall be unlawful for any person or entity operating a commercial vehicle to unreasonably delay the provision of travel logs after a request has been made by a regulatory authority or law enforcement officer.

Section 3: Exceptions

  1. Lawful Exceptions:

    • This code shall not apply to instances where the request for travel logs is made under circumstances that do not comply with applicable regulations or where the request exceeds the legal authority of the requesting party.

  2. Unintentional Delays:

    • This code shall not apply to instances where delays in providing travel logs are proven to be unintentional and promptly addressed upon discovery, provided that no obstruction or non-compliance is involved.
