PC §713 - WINDOW TINT

INFRACTION

(a) Definition

A window tint violation occurs when a motor vehicle's windows are tinted in a manner that violates state laws and regulations governing window tinting.

(b) Elements of the Offense

The following elements must be met to constitute a window tint violation:

  1. The defendant owns or operates a motor vehicle with tinted windows.

  2. The level of tint on the windows exceeds the maximum allowable limit set by state laws and regulations.

  3. The defendant knew or should have known that the tint level on the windows exceeded legal limits.

Maximum Allowable Tint Levels

(a) The maximum allowable tint levels for vehicle windows is the light smoke tint which must allow light into the motored vehicle. The driver and passengers must be visible from the exterior.

Exemption

The only exemption of the legal limit of light smoke tint is if there is a signed and approved doctors note signifying that the driver is required to have a darker tint to the motor vehicle.

Types of Violations

(a) Violations of window tint laws may include, but are not limited to, the following:

  1. Tinting the front windshield or front side windows in a manner that exceeds legal limits.

  2. Applying aftermarket tint film that does not meet state specifications or certification requirements.

  3. Failing to display required certification or compliance stickers on tinted windows as mandated by state laws.

(c) Defenses

  • (a) It shall be a defense to a charge of window tint violation if the defendant can prove that their vehicle's tinting complies with state laws and regulations, or if they can demonstrate that they were unaware of the illegal tint at the time of the violation.

  • (b) Lack of evidence of a window tint violation, such as errors in law enforcement measurements or documentation, may also serve as defenses if proven by the defendant.

(d) Aggravating Factors

  • Aggravating factors such as prior convictions for window tint violations, knowingly violating window tint laws, or causing accidents due to impaired visibility from tinted windows may result in enhanced penalties or additional charges as determined by the court.
