CLASS E FELONY

(a) Definition

Terrorism is the act of engaging in or supporting violent or unlawful activities with the intent to intimidate, coerce, or terrorize a civilian population, government, or society for ideological, political, religious, or other unlawful purposes.

Types of Terrorism

Terrorism may include, but is not limited to, the following:

  1. Acts of violence or destruction targeting civilians, government officials, law enforcement personnel, or infrastructure.

  2. Use of weapons of mass destruction, explosives, or firearms to cause widespread fear, harm, or destruction.

  3. Cyberterrorism: Using computer networks or technology to disrupt critical infrastructure, communication systems, or financial networks.

  4. State-sponsored terrorism: Governments or state actors supporting or funding terrorist organizations or activities to advance political or strategic objectives.

(b) Elements of the Offense

The following elements must be met to constitute terrorism:

  1. The defendant engaged in or supported violent or unlawful activities.

  2. The activities were intended to intimidate, coerce, or terrorize a civilian population, government, or society.

  3. The defendant acted willfully and knowingly with the intent to advance ideological, political, religious, or other unlawful agendas through violence or fear.

(c) Defenses

  • (a) It shall be a defense to a charge of terrorism if the defendant can prove that their conduct was not intended to intimidate, coerce, or terrorize others, or if they can demonstrate that they were acting under duress, coercion, or manipulation by others at the time of the offense.

  • (b) Lack of evidence linking the defendant to the terrorist activities or absence of intent to commit acts of terrorism may also serve as defenses if proven by the defendant.

(d) Aggravating Factors

Aggravating factors such as the loss of life, serious bodily injury, significant property damage, the use of weapons of mass destruction, or coordination with foreign terrorist organizations may result in enhanced penalties or additional charges as determined by the court.

Penalties

(a) Terrorism is typically a felony offense punishable by imprisonment in state prison for a period determined by the court, fines, or both.

(b) Individuals convicted of terrorism may face severe penalties, including life imprisonment without parole or the death penalty in jurisdictions where it is permitted by law.
