PC §714 - ENGAGING IN ILLEGAL VEHICLE STREET RACE

CLASS E MISDEMEANOR

(a) Definition

Engaging in a vehicle street race is the act of participating in, organizing, facilitating, or otherwise supporting a motor vehicle race on public roadways, streets, or highways for the purpose of competition or speed.

(b) Elements of the Offense

The following elements must be met to constitute engaging in a vehicle street race:

  1. The defendant participated in, organized, facilitated, or supported a motor vehicle race.

  2. The race took place on public roadways, streets, or highways.

  3. The race involved vehicles competing for speed or performance.

Types of Violations

(a) Violations of engaging in a vehicle street race may include, but are not limited to, the following actions:

  1. Participating in illegal street racing events or competitions.

  2. Organizing or promoting street racing events through social media, word of mouth, or other means.

  3. Providing financial support, equipment, or resources to facilitate street racing activities.

  4. Acting as a lookout, timer, or other role to assist participants in evading law enforcement during street races.

(c) Defenses

  • (a) It shall be a defense to a charge of engaging in a vehicle street race if the defendant can prove that they were not involved in organizing, participating in, or supporting street racing activities, or if they can demonstrate that they were coerced, misled, or otherwise not acting of their own free will.

  • (b) Lack of evidence of participation in a street race, such as errors in law enforcement observations or documentation, may also serve as defenses if proven by the defendant.

(d) Aggravating Factors

  • Aggravating factors such as causing accidents or injuries due to street racing, participating in organized street racing clubs or associations, or prior convictions for similar offenses may result in enhanced penalties or additional charges as determined by the court.
