PC §400 - BRIBERY OF A GOVERNMENT OFFICIAL

CLASS E MISDEMEANOR

(a) Definition

Bribery is the act of offering, giving, receiving, soliciting, or accepting something of value, with the intent to influence the actions or decisions of an individual in a position of authority, public official, or person entrusted with a public duty.

(b) Elements of the Offense

The following elements must be met to constitute bribery:

  1. The offering, giving, receiving, soliciting, or accepting something of value.

  2. The intent to influence the actions or decisions of an individual in a position of authority or public official.

  3. The individual in a position of authority or public official is involved in a public duty or government function.

Types of Bribery

(a) Bribery may include, but is not limited to, the following:

  1. Offering money or gifts to a public official in exchange for favorable treatment or decisions.

  2. Accepting bribes as a public official in exchange for abusing power or authority.

  3. Soliciting or receiving bribes as a public official or person entrusted with a public duty.

(c) Defenses

  • (a) It shall be a defense to a charge of bribery if the defendant can prove that the offer, solicitation, acceptance, or giving of something of value was not made with the intent to influence an official action or decision.

(d) Aggravating Factors

  • Aggravating factors such as the amount of the bribe, the level of influence sought or exerted, or prior convictions for similar offenses may result in increased penalties as determined by the court.
