PC §802 - FAILURE TO REACH TRACTOR OR TRAILER RESTRICTIONS

CLASS E MISDEMEANOR

Section 1: Definitions

  1. Tractor: A motor vehicle designed primarily for towing or pushing other vehicles, often used in combination with trailers or semi-trailers.

  2. Trailer: A non-motorized vehicle designed to be towed by a motor vehicle, used for transporting goods, cargo, or passengers.

  3. Tractor or Trailer Restrictions: Legal requirements or regulations that specify the maximum weight, size, load distribution, and other operational limitations for tractors and trailers.

  4. Regulatory Authority: Any government agency or body responsible for overseeing and enforcing regulations related to tractors, trailers, and commercial vehicles, including but not limited to the Department of Transportation (DOT) or similar entities.

Section 2: Offenses

  1. Failure to Comply with Tractor Restrictions:

    • It shall be unlawful for any person to operate a tractor that exceeds the weight, size, or operational restrictions imposed by regulatory authorities.

  2. Failure to Comply with Trailer Restrictions:

    • It shall be unlawful for any person to operate a trailer that exceeds the weight, size, or operational restrictions imposed by regulatory authorities.

  3. Improper Load Distribution:

    • It shall be unlawful for any person to operate a tractor or trailer with improper load distribution that fails to meet the requirements established by regulatory authorities, which may affect safety and compliance.

  4. Inadequate Maintenance:

    • It shall be unlawful for any person to operate a tractor or trailer that has not been maintained or repaired in accordance with the safety and operational standards required by regulatory authorities.

Section 3: Additional Provisions

  1. Revocation of Operating Licenses:

    • The court may order the revocation or suspension of the commercial operating license of any person or entity convicted of falsification of travel logs or repeated violations of travel log regulations.

  2. Tow:

    • The law enforcement officer may tow the tractor and trailer due to the lack of a valid CDL of San Andreas.

Section 4: Exceptions

  1. Lawful Record-Keeping:

    • This code shall not apply to instances where travel logs are maintained in accordance with lawful record-keeping practices and regulatory requirements, and where any deficiencies are promptly corrected.

  2. Unintentional Errors:

    • This code shall not apply to instances where errors in travel logs are proven to be unintentional and promptly corrected upon discovery, provided that no intentional falsification or obstruction of regulatory requirements is involved.
