PC §805 - FAILURE TO HAVE PROPER SAFETY EQUIPMENT

INFRACTION

Section 1: Definitions

  • Safety Equipment: Equipment required by law to be present and functional in a commercial vehicle to ensure safety, including but not limited to emergency kits, fire extinguishers, reflective warning devices, safety belts, and any other items mandated by regulatory authorities.

  • Commercial Vehicle: A motor vehicle used for transporting goods, passengers, or both, operated for business purposes or for compensation.

  • Regulatory Authority: Any government agency or body responsible for overseeing and enforcing safety equipment requirements for commercial vehicles, including but not limited to the Department of Transportation (DOT) or similar entities.

  • Failure to Have Proper Safety Equipment: The act of not equipping a commercial vehicle with the safety equipment required by regulatory authorities or failing to maintain the equipment in a functional state.

Section 2: Offenses

  • Failure to Equip Vehicle with Required Safety Equipment:

    • It shall be unlawful for any person to operate a commercial vehicle that is not equipped with the safety equipment required by regulatory authorities.

  • Non-Functional Safety Equipment:

    • It shall be unlawful for any person to operate a commercial vehicle with safety equipment that is present but non-functional or in disrepair, rendering it ineffective in ensuring safety.

  • Failure to Maintain Safety Equipment:

    • It shall be unlawful for any person to neglect the maintenance of required safety equipment, leading to its deterioration or ineffectiveness.

Section 3: Additional Provisions

  1. Revocation of Operating Licenses:

    • The court may order the revocation or suspension of the commercial operating license of any person or entity convicted of falsification of travel logs or repeated violations of travel log regulations.

  2. Tow:

    • The law enforcement officer may tow the tractor and trailer due to the lack of a valid CDL of San Andreas.

Section 4: Exceptions

  1. Lawful Record-Keeping:

    • This code shall not apply to instances where travel logs are maintained in accordance with lawful record-keeping practices and regulatory requirements, and where any deficiencies are promptly corrected.

  2. Unintentional Errors:

    • This code shall not apply to instances where errors in travel logs are proven to be unintentional and promptly corrected upon discovery, provided that no intentional falsification or obstruction of regulatory requirements is involved.
