PC §731 - DRIVING UNDER THE POSTED SPEED LIMIT
INFRACTION
Section 1: Definitions
Driving Under the Speed Limit: Operating a vehicle at a speed significantly below the posted speed limit without justifiable cause, creating a hazard for other vehicles on the road.
Vehicle: Any mode of transportation that requires operation by a person, including but not limited to cars, motorcycles, trucks, bicycles, and scooters.
Person: Any individual, partnership, corporation, association, or other entity.
Justifiable Cause: Circumstances that reasonably necessitate driving below the speed limit, such as adverse weather conditions, heavy traffic, road construction, or vehicle mechanical issues.
Section 2: Offenses
Unjustified Slow Driving:
It shall be unlawful for any person to drive a vehicle at a speed that is significantly below the posted speed limit without justifiable cause, causing obstruction or hazard to the normal flow of traffic.
Obstruction of Traffic:
It shall be unlawful for any person to operate a vehicle at a speed that impedes the normal and reasonable movement of traffic, unless such reduced speed is necessary for safe operation or in compliance with the law.
Section 3: Exceptions
Adverse Conditions:
This code shall not apply to persons driving under the speed limit due to adverse weather conditions, heavy traffic, road construction, or vehicle mechanical issues that necessitate reduced speed for safety.
Compliance with Law:
This code shall not apply to persons driving under the speed limit in compliance with other legal requirements, such as yielding to emergency vehicles or obeying traffic control devices.
