INFRACTION

Section 1: Definitions

  1. Jaywalking: The act of crossing a roadway outside of designated crosswalks or intersections in a manner that impedes the flow of traffic or endangers pedestrians and drivers.

  2. Roadway: Any part of a street or highway used for vehicular travel, including lanes and shoulders.

  3. Designated Crosswalk: A marked portion of the roadway intended for pedestrian use, typically with painted lines and sometimes accompanied by traffic control signals.

  4. Intersection: The area where two or more roadways meet or cross.

Section 2: Offenses

  1. Crossing Outside a Crosswalk:

    • It shall be unlawful for any person to cross a roadway outside of a designated crosswalk or intersection, in a manner that disrupts the flow of traffic or creates a hazard to themselves or others.

  2. Impediment to Traffic:

    • It shall be unlawful for any person to cross a roadway in a manner that obstructs or interferes with the normal flow of vehicular traffic, creating a potential hazard for drivers.

  3. Endangerment:

    • It shall be unlawful for any person to cross a roadway in a manner that endangers themselves or others, including but not limited to crossing at high traffic areas, at night, or during adverse weather conditions without adequate visibility.

Section 3: Exceptions

  1. Emergency Situations:

    • This code shall not apply to individuals who cross a roadway in an emergency situation where immediate action is necessary to avoid harm or to provide assistance, provided that such action is taken with reasonable care.

  2. Lawful Crossings:

    • This code shall not apply to crossings made at designated pedestrian crossings or under conditions where the crossing is permitted by traffic control signals or other legal provisions.

  3. First Amendment Protections:

    • This code shall not apply to individuals engaged in lawful protests or demonstrations, provided that the crossing does not endanger themselves or others and is conducted in accordance with any applicable permits or regulations.
