PC §804 - FAILURE TO ABIDE TO A VEHICLE INSPECTION

CLASS E MISDEMEANOR

Section 1: Definitions

  • Vehicle Inspection: A mandated examination of a vehicle to ensure compliance with safety, emissions, and operational standards as set by regulatory authorities.

  • Regulatory Authority: Any government agency or body responsible for overseeing and enforcing vehicle inspection requirements, including but not limited to the Department of Transportation (DOT) or similar entities.

  • Failure to Abide: The act of not complying with scheduled or required vehicle inspections, including failing to submit the vehicle for inspection, not completing required repairs, or disregarding inspection findings.

Section 2: Offenses

  • Failure to Submit Vehicle for Inspection:

    • It shall be unlawful for any person to fail to submit a vehicle for inspection as required by regulatory authorities.

  • Failure to Complete Required Repairs:

    • It shall be unlawful for any person to fail to complete required repairs or modifications to a vehicle following an inspection that identifies non-compliance issues.

  • Operating a Vehicle Without Valid Inspection:

    • It shall be unlawful for any person to operate a vehicle that has not passed a required inspection or is overdue for an inspection as mandated by regulatory authorities.

  • Providing False Information During Inspection:

    • It shall be unlawful for any person to provide false information or documentation related to the vehicle’s condition or inspection status.

Section 3: Additional Provisions

  1. Revocation of Operating Licenses:

    • The court may order the revocation or suspension of the commercial operating license of any person or entity convicted of falsification of travel logs or repeated violations of travel log regulations.

  2. Tow:

    • The law enforcement officer may tow the tractor and trailer due to the lack of a valid CDL of San Andreas.

Section 4: Exceptions

  1. Lawful Record-Keeping:

    • This code shall not apply to instances where travel logs are maintained in accordance with lawful record-keeping practices and regulatory requirements, and where any deficiencies are promptly corrected.

  2. Unintentional Errors:

    • This code shall not apply to instances where errors in travel logs are proven to be unintentional and promptly corrected upon discovery, provided that no intentional falsification or obstruction of regulatory requirements is involved.
